Can my husband divorce me without me knowing? ›

Getting a divorce in California

A spouse cannot stop a divorce through legal means. Only the petitioner can choose not to continue with the process. The only thing a respondent in a divorce case can do is file a motion to contest the petitioner's terms.

Although you can complete a divorce without your spouse's consent, you must take steps to notify him or her of your intention to divorce. If you cannot locate your spouse, you can still file for divorce, but only after you have taken steps to attempt to locate and serve him or her with the divorce papers.

With an uncontested divorce, you typically don't have to attend a hearing in New York to get your final divorce judgment. The judge will simply review all of your paperwork and, if everything is in order, will sign the judgment.

The husband and wife must be living separate and apart for a period of at least one year after signing a separation agreement to use it for a divorce.

The Guidelines also provides for the “Rule of 65”, which states that if the years of marriage plus the age of the support recipient at the time of separation equals or exceeds 65, then spousal support may be paid indefinitely.
